Terms of Service

Biasque is an analytics product that observes how AI shopping agents discover, evaluate, and select products available through public commerce catalogs (including those exposed via the Shopify Catalog MCP). The Service provides dashboards, search tools, and notifications that summarize this activity for merchants and researchers.

Aggregated, anonymized analytics about stores and products observed by the Service — such as appearance counts, selection rates, and AI-generated search queries — are displayed on publicly accessible pages of the Service. By submitting a store or product to the Service, you acknowledge that aggregated analytics derived from public catalog data about that store or product may be publicly visible or shared with third parties for research, analytics, or commercial purposes.

The Service is provided on an "as is" and "as available" basis. Features, data sources, and pricing may change, and portions of the Service may be added, modified, or discontinued at any time.

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use the Service. By using the Service you represent that you meet this requirement and that you have the authority to bind any organization on whose behalf you are acting.

Accounts are created through third-party identity providers (currently Google). You are responsible for safeguarding access to the account you authenticate with and for all activity that occurs under your session.

You agree not to, and not to allow any third party to:

• Use the Service to violate any law or the rights of others.
• Attempt to gain unauthorized access to the Service, other users' accounts, or the underlying infrastructure.
• Reverse engineer, scrape, or systematically extract data from the Service except through interfaces we explicitly provide.
• Use the Service to send unsolicited communications, spam, malware, or to interfere with the Service's operation.
• Misrepresent ownership of, or rights to, products or stores you submit for monitoring.
• Share, sell, or transfer your API key to any third party. Each API key is personal to your account; you are responsible for all requests made with it.
• Use the Monitor API in a manner that exceeds the daily usage limits applied to your account, attempt to circumvent those limits, or use automated tooling to drive traffic in excess of normal usage patterns.

You may submit information to the Service, such as store URLs, product handles, search queries, watchlists, and API keys. You represent that you have the right to submit this information and grant us a worldwide, non-exclusive license to process it solely to operate, secure, and improve the Service.

We do not claim ownership of merchant data. You retain all rights to content you submit.

The Service relies on third-party platforms, including but not limited to Google (authentication), Shopify (catalog data and the Shopify Catalog MCP), Cloudflare (hosting and storage), and large language model providers used for AI features. Your use of those platforms is subject to their own terms. We are not responsible for changes to or unavailability of those services.

Data observed from public commerce catalogs is presented for informational purposes only. We do not guarantee accuracy, completeness, or timeliness of third-party data.

Portions of the Service generate output using large language models. Such output is provided as suggestions or summaries and may be inaccurate, incomplete, or out of date. You should independently verify any output before relying on it for business decisions.

The Service may display AI-generated evaluation text explaining why a product was or was not selected in response to a query. These evaluations are produced automatically by language models based on publicly available catalog data and the user's query context. They do not represent the opinions, endorsements, or editorial judgments of us, and they are not intended as statements of fact about the quality, safety, or desirability of any product or store. AI-generated evaluations may be inaccurate, incomplete, or misleading. We disclaim all liability for any reputational impact or other harm arising from such evaluations.

The Service uses its own AI agent implementation and does not reproduce or simulate the behavior of any specific third-party AI service (including but not limited to ChatGPT or Google Gemini). Results generated by the Service may differ materially from those of any such third-party service. The Service is not affiliated with or endorsed by any third-party AI provider.

Signed-in users may generate an API key to access the Monitor API programmatically. API keys are issued per account and subject to daily usage limits, which may vary by plan. Limits exist to ensure fair access and service stability; we reserve the right to adjust them at any time.

If your key is compromised, regenerate it immediately from the dashboard. We are not liable for unauthorized use resulting from your failure to safeguard your key.

Portions of the Service may be free; others may require payment. If paid plans are offered, the applicable fees, billing cycle, and refund policy will be presented before you subscribe. Unless required by law, fees are non-refundable.

The Service, including its software, design, and aggregated analytics (excluding your data and third-party data), is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service in accordance with these Terms.

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the Service. On termination, your right to use the Service ends, though provisions that by their nature should survive (including Sections 9, 11, 12, and 13) will remain in effect.

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. AI-GENERATED CONTENT, INCLUDING PRODUCT EVALUATIONS AND SELECTION REASONING, IS PROVIDED WITHOUT ANY WARRANTY OF ACCURACY, COMPLETENESS, OR FITNESS. WE ARE NOT LIABLE FOR ANY DAMAGE TO REPUTATION, BUSINESS, OR GOODWILL ARISING FROM AI-GENERATED EVALUATIONS DISPLAYED ON THE SERVICE.

TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUES, GOODWILL, OR DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD 100.

You agree to defend, indemnify, and hold us harmless from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your data, or your violation of these Terms.

We may update these Terms from time to time. If we make material changes, we will notify you through the Service or by other reasonable means before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

These Terms are governed by the laws of Japan, without regard to its conflict of laws rules. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the courts located in Tokyo, Japan, unless required otherwise by mandatory law in your country of residence.
